Paid advertising usage is licensed differently than standard professional or editorial image use. This page explains what is considered paid advertising, what is not, and how advertising usage is licensed across all photography services offered by Idaho Photography Studios.

This page exists to provide clarity. Advertising usage is determined by how images are distributed, not by profession, industry, or whether the person photographed is the brand.

What Is Considered Paid Advertising

Paid advertising is defined by paid distribution or paid placement.

An image is considered to be used in paid advertising when money is paid to promote, distribute, or amplify that image to an audience.

Paid advertising includes (but is not limited to):

  • Google Ads and display ads
  • Facebook, Instagram, LinkedIn, or other social media ads
  • Sponsored or boosted posts
  • Paid placements on websites or platforms
  • Magazine or newspaper advertisements
  • Featured listings or promoted content
  • Lead-generation campaigns
  • Retargeting ads
  • Billboards or large-scale paid displays

If money is spent to push an image to an audience, the usage is considered paid advertising.


What Is Not Considered Paid Advertising

Not all professional or business uses of photography are considered paid advertising.

The following uses are not considered paid advertising and do not require an advertising license, provided no money is paid to promote or amplify the image itself:

  • Website bios, profile pages, and “About” pages
  • Company team or staff pages
  • Professional directories or credential listings
  • Business cards and stationery
  • Email signatures
  • Presentation materials and speaking profiles
  • Internal company communications or directories
  • Editorial or press features (non-sponsored)
  • Organic (non-paid) social media posts

Industry-specific examples – not considered Paid Advertising (for clarity):

  • Real Estate: MLS listings, brokerage profile pages, listing packets, printed property flyers
  • Legal & Financial: Attorney bios, firm websites, professional directories, client-facing materials
  • Medical & Healthcare: Physician profile pages, clinic websites, hospital directories
  • Corporate & Small Business: Company websites, leadership pages, internal communications
  • Consultants & Professionals: Personal websites, credential listings, speaker bios
  • Education & Nonprofits: Faculty directories, organizational websites, annual reports

Paying for printing, production, platform access, membership fees, or directory inclusion does not constitute paid advertising. These uses are considered professional identification and representation, not promotion.


Paid Distribution vs. Platform Participation

  • Paid distribution means paying to promote or amplify an image through advertising platforms, sponsored placements, or paid media.
  • Platform participation means paying for access, membership, or inclusion where images appear as part of a profile, listing, or directory.

Examples:

  • Paying for social media ads, sponsored posts, or display ads → Paid advertising
  • Paying for membership in a professional association → Not advertising
  • Paying for directory inclusion or credential listings → Not advertising
  • Paying to feature or promote content → Paid advertising

Advertising requires intentional promotion, not passive presence.
