Copyright, Usage & Studio Watermark

COPYRIGHT, IMAGE USAGE & STUDIO MARK POLICY

Idaho Photography Studios creates original photographic works that are protected under United States Copyright Law. This policy explains copyright ownership, image usage, proofing standards, and permitted use across all photography services offered by the studio.

This page establishes global standards. Service-specific usage details (such as business, paid advertising, or product use) are defined in the applicable service or usage policy.


1) Copyright Ownership

All photographs, digital files, edits, retouching, composites, and derivative works created by Idaho Photography Studios remain the exclusive copyrighted property of the studio unless a separate written agreement explicitly transfers ownership.

Payment for photography services, sessions, prints, or digital files does not transfer copyright ownership.


2) What Clients Are Purchasing

When commissioning photography, clients are purchasing:

  • Professional photography services (time, expertise, equipment, and production)

  • Post-production and retouching (where included)

  • A defined usage license granting permission to use selected images in specific ways

Licensing ensures clarity, protects image value, and allows photography to be priced appropriately for its intended use.


3) Usage Licenses (Service-Dependent)

Usage rights vary based on the type of photography commissioned and how the images will be used.

Common usage categories include (but are not limited to):

  • Personal or portrait use

  • Professional or business use

  • Editorial use

  • Commercial or advertising use

  • eCommerce or product listings

The scope of usage granted is defined by the applicable service policy, proposal, invoice, or written agreement. Uses outside the original scope require additional licensing.


4) Watermarked Proofs vs. Final Delivered Images

Watermarked proofs are always watermarked.
Proof images are provided for review and image selection only. They may not be posted, shared publicly, used in marketing, or provided to third parties. Proofs are not final deliverables.

Final delivered images are provided only after selected images have been purchased and/or licensed and final processing has been completed.

Presentation standards for final delivered images vary by service type.
For example:

  • Portrait services may include a discreet studio mark as part of the presentation standard.

  • Business, commercial, or advertising services typically deliver images without a studio mark unless otherwise agreed in writing.


5) Alterations, Filters & AI Modifications

Clients may make minor technical adjustments to final delivered images for formatting or placement purposes only. Permitted adjustments are limited to small, non-destructive changes that do not materially alter the appearance of the image.

Examples of permitted adjustments include:

  • Cropping or resizing for layout

  • Minor exposure or color balance adjustments
  • Basic sharpening for output

  • Conversion to black & white using standard methods

These adjustments should not exceed approximately 10–15% visual deviation from the original delivered image.

The following are not permitted without written approval:

  • Heavy filters or stylized effects

  • AI-based alterations, beauty filters, or face/body reshaping

  • Background replacement or object removal

  • Composite imagery

  • Logo removal or masking

  • Any edit that materially alters the subject’s appearance, changes the intent of the image, or misrepresents the original work

If additional or alternative edits are required, they must be requested through the studio and may be subject to additional fees.


6) Sharing, Transfer & Third-Party Use

Usage licenses are granted to the client and/or subject as defined in the agreement. Images may not be sold, sublicensed, transferred, or provided to third parties (including vendors, agencies, franchises, publications, or partners) for their own use without written permission or an updated license.


7) Prohibited Use

The following uses are never permitted without explicit written authorization:

  • Stock licensing or image marketplaces

  • Free image distribution or giveaways

  • Use implying endorsement of a product, service, or cause

  • Defamatory, misleading, or unlawful use

  • Removal of copyright notices, metadata, or embedded identifiers


8) Model & Property Releases

Model and property releases are separate from copyright and licensing. Certain types of use — particularly advertising, commercial distribution, or third-party placements — may require appropriate releases.

Release requirements are determined by the intended use of the images, not simply by their creation.


9) Infringement & Unauthorized Use

Unauthorized use of copyrighted images may result in licensing enforcement, removal requests, or legal remedies. If you believe an image has been misused or improperly distributed, please contact the studio with relevant details so the matter can be addressed appropriately.
